PerglotFit respects your privacy. This Privacy Policy explains how Perglot LLC ("PerglotFit," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit our website, use our mobile application, purchase our products, or use our subscriptions, memberships, fitness and nutrition features, and related services (collectively, the "Services").

By using the Services, you acknowledge the practices described in this Privacy Policy. Capitalized terms not defined here have the meaning given in our Terms of Service.

1. Information We Collect

Information you provide to us

Account and contact information, such as your name, email address, phone number, shipping and billing addresses, account credentials, and the content of your communications with our support team.

Order information, such as the products you purchase, subscription status, order and shipping history, returns and refunds, discount or referral codes used, and transaction details. Full payment-card numbers are handled by our payment processors and are not stored by PerglotFit.

Fitness and nutrition information you choose to share when using personalized features, such as age, height, weight, body measurements, fitness goals, activity level, training experience, available equipment, workout frequency, dietary and food preferences, calorie or macronutrient targets, progress check-ins, and progress photographs. Providing this information is optional, and we use it only to deliver and improve the personalized Services you request. PerglotFit is not a healthcare provider. Please do not share medical information that is not needed to use the Services.

Reviews, testimonials, and other content you submit for posting or promotional consideration.

Information collected automatically

When you use our website or app, we and our service providers automatically collect device and usage information, such as IP address, browser and device type, operating system, pages viewed, links clicked, referring pages, approximate location derived from IP address, cookie and device identifiers, and similar technical data.

Information from other sources

We may receive information from our e-commerce platform, payment processors, shipping carriers, advertising and analytics partners, and from people who refer you to PerglotFit through our referral program.

2. How We Use Information

We use personal information to:

• Process, fulfill, and ship orders and manage subscriptions;
• Create and manage your account;
• Deliver fitness and nutrition plans and personalized recommendations;
• Track progress when you ask us to;
• Process payments and prevent fraud;
• Provide customer support and communicate about orders, accounts, and subscriptions;
• Send marketing communications where permitted (you can opt out at any time);
• Administer promotions, referral programs, and member gifts;
• Improve our products, website, app, and Services;
• Maintain the security of our systems; and
• Comply with legal obligations and enforce our agreements.

3. Personalized Services

Information you submit through questionnaires, check-ins, and similar features is used to generate personalized fitness and nutrition recommendations. These recommendations are informational only and are not medical diagnoses or treatment.

4. Payment Processing

Payments are processed by third-party payment processors, including the payment providers offered through our e-commerce platform (Shopify). Those processors collect and handle your payment information under their own privacy policies. PerglotFit receives only limited information, such as a transaction identifier, payment status, card type, and the last four digits of your card.

5. Cookies and Similar Technologies

We and our service providers use cookies, pixels, local storage, and similar technologies to keep the website working, remember your preferences, maintain your session and cart, understand how the Services are used, measure performance, detect fraud, and deliver and measure advertising.

Where required by law, we will ask for your consent before using non-essential cookies. You can also block or delete cookies through your browser or device settings, although some features may not work correctly afterward.

6. Analytics and Advertising

We use third-party analytics and advertising services to understand how people use PerglotFit and to show you relevant ads on other websites and apps. These providers may process device identifiers, cookie data, IP addresses, and interaction data. Where applicable law gives you the right to opt out of targeted advertising, you can do so as described in Section 8 and Section 13.

7. How We Share Information

We share personal information with:

• Service providers that perform services for us, including e-commerce hosting, payment processing, shipping and fulfillment, customer support, email and SMS delivery, analytics, fraud prevention, advertising, and professional services;
• Advertising and analytics partners, as described in Section 6;
• Legal and safety recipients, when reasonably necessary to comply with law, respond to lawful requests, enforce our agreements, protect the rights, property, or safety of PerglotFit, our customers, or others, or investigate fraud or security incidents; and
• A successor business, as described in Section 16.

We do not share fitness, nutrition, or progress information with third parties for their own marketing purposes.

8. We Do Not Sell Personal Information for Money

PerglotFit does not sell personal information in exchange for money. However, some of the advertising and analytics practices described above may be considered a "sale," "sharing," or "targeted advertising" under certain state privacy laws even though no money changes hands.

You can opt out of these practices at any time by emailing support@perglot.com with the subject line "Do Not Sell or Share My Personal Information." Where required by law, we also honor the Global Privacy Control (GPC) browser signal as an opt-out request.

9. Marketing Communications

If you subscribe to promotional emails, you can unsubscribe at any time using the link in any marketing email. You will continue to receive transactional messages about your orders, payments, subscriptions, security, and account.

10. Text Messages

If you separately consent to receive text messages, we will send messages according to the consent you gave. Consent to promotional texts is not a condition of purchase. You can opt out at any time by replying STOP. Message and data rates may apply.

11. Data Retention

We keep personal information for as long as reasonably necessary to provide the Services, maintain transaction records, resolve disputes, prevent fraud, and meet legal, tax, accounting, and regulatory obligations. Retention periods vary by the type of information and the applicable legal requirements. You can ask us to delete your information as described in Section 13.

12. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.

13. Your Privacy Rights

Depending on where you live, you may have the right to:

• Know what personal information we have collected about you and request a copy;
• Correct inaccurate personal information;
• Delete your personal information;
• Opt out of the sale or sharing of personal information and of targeted advertising;
• Withdraw consent you previously gave; and
• Appeal a decision we make about your request.

To exercise any of these rights, email support@perglot.com. We may need to verify your identity before completing your request, and we will respond within the time required by applicable law. You may use an authorized agent to submit a request on your behalf if you give the agent written permission. We will not discriminate against you for exercising your privacy rights.

Additional information for California residents

In the past 12 months, we have collected the categories of personal information described in Section 1 (identifiers; contact and commercial information; internet and device activity; approximate geolocation; and, if you use personalized features, physical characteristics such as height, weight, and progress photographs). We collect this information from the sources and for the purposes described in Sections 1 and 2, and we disclose it to the categories of recipients described in Section 7. We do not knowingly collect personal information from anyone under 16. California residents may also request, once per year, information about our disclosures of personal information to third parties for their direct marketing purposes.

Consumer health data

Some fitness and nutrition information (for example, weight, body measurements, or progress photographs) may be treated as "consumer health data" under the laws of certain states, including Washington, Nevada, and Connecticut. We collect this information only with your consent and only to provide the personalized Services you request. We do not sell it, and we do not share it with third parties for their own purposes. You may withdraw consent or request deletion at any time using the contact information above.

14. Children's Privacy

The Services are intended for adults and are not directed to anyone under 18. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact support@perglot.com and we will delete it.

15. Third-Party Websites and Services

The Services may link to or integrate with third-party websites and services. Their privacy practices are governed by their own policies, and PerglotFit is not responsible for them.

16. Business Transfers

If PerglotFit is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, personal information may be transferred as part of that transaction, subject to applicable law and this Privacy Policy.

17. Where We Process Information

PerglotFit is based in the United States, and we process and store personal information in the United States. If you access the Services from outside the United States, you understand that your information will be transferred to and processed in the United States.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top identifies the current version. Where required by law, we will provide additional notice of material changes.
